Trust Elections

Making a Family Trust or Interposed Entity Election has been seen for many years as a relatively straightforward matter.  Now the ATO is proactively reviewing these rules the complexities are starting to emerge.  We will cover:

  • How and when to validly make an election;
  • Issues that can cause an election to fail entirely;
  • How to choose an earlier start year, and the risks and difficulties which can emerge;
  • Impact on elected entities for the death of the test individual;
  • Managing families where there ar multiple test individuals;
  • How to review both new and existing clients for these risks;
  • Give worked examples of issues and risks, together with possible solutions; and
  • Provide an overview of how and to whom FTDT applies .
